Questions are normal. Prenups are important.

We've designed 123 Prenup to make the process easier to understand from the very beginning. Here are answers to some of the questions couples ask most often.

Getting Started

What is 123 Prenup?

123 Prenup is a guided technology platform that helps couples create a personalized prenuptial agreement. The process helps both partners understand the important financial decisions, organize financial disclosure, compare their choices through 123 Match, resolve disagreements if necessary, and create a prenup based on the decisions they make. Build. Match. Create.

How much does 123 Prenup cost?

The complete 123 Draft experience is $499 per couple. If you need mediation, you can upgrade: 2-Hour Mediation — $999 total · 4-Hour Mediation — $1,499 total · Complete Mediation — $2,999 total. If you've already paid $499, that amount is credited toward your mediation upgrade. Independent attorney services, if you choose to use them, are separate.

Is the $499 price per person or per couple?

Per couple. The $499 price includes the 123 Prenup process for both partners, including separate accounts, financial disclosure, 123 Match and creation of your personalized prenup.

Do we both need to participate?

Yes. 123 Prenup is designed as a two-person process. Each partner completes their own portions of the questionnaire and financial disclosure so that 123 Match can compare your decisions. One person can start the process and invite the other partner to join.

Do we need to agree on everything before we start?

No. That's one of the reasons we created 123. You can start without having every issue resolved. 123 Match helps identify exactly where you agree and where you don't. You can then work through any differences yourselves or use 123 Mediation if you want help.

How 123 Works

What is 123 Match?

123 Match is one of the core features of 123 Prenup. Each partner answers important questions independently. 123 then compares your answers. When your answers match, you know you've reached agreement on that issue. When they don't, 123 identifies the difference so you can focus on what still needs to be resolved. Instead of beginning with a legal document to negotiate, you begin with your decisions.

What kinds of issues will 123 ask us about?

Depending on your circumstances, 123 may guide you through decisions involving: separate property, income and appreciation, businesses and professional interests, real estate, joint property and accounts, retirement assets, debts and liabilities, spousal support, inheritance and estate rights, financial disclosure, and other provisions that may be relevant to your prenup. The questions are designed to make sophisticated concepts understandable without requiring you to know legal terminology.

What happens if we answer a question differently?

123 Match identifies the disagreement. You can discuss the issue together and change your selections if you reach agreement. If you'd like help, you can upgrade to 123 Mediation and have a neutral mediator work with both of you on the unresolved issues.

Does 123 use AI?

123 may use technology, including AI, to help make the process more efficient and understandable. But 123 isn't simply an AI prompt that generates a legal document. The platform uses a structured prenup process developed around decades of matrimonial-law experience, including defined questions, follow-up logic, financial disclosure, 123 Match, complexity detection and agreement-generation rules. AI may help power the technology. It doesn't replace the legal architecture behind it.

Why shouldn't I just ask ChatGPT or another AI tool to write a prenup?

AI can generate language. The harder part is knowing what questions should be asked, what information matters, which follow-up questions depend on your answers, how different choices affect the agreement, and when a situation requires additional professional attention. 123 was built specifically around the prenup process. The value isn't simply generating a document. It's the process that gets you there.

Financial Disclosure

Do we have to disclose our finances?

Financial disclosure is an important part of the 123 Prenup process. 123 guides each partner through an organized disclosure of relevant financial information, including income, assets and liabilities. The platform is designed to make disclosure straightforward rather than overwhelming.

What financial information will I need?

You'll generally be asked to provide information about your income and summarize assets and liabilities that may include: bank accounts, investments, retirement accounts, real estate, business interests, trust interests, personal property, other significant assets, debts and liabilities. You'll also be asked for information from your most recently filed tax return. The exact information requested may depend on your circumstances.

Do I have to upload every bank and investment statement?

Not necessarily. 123 is designed to make disclosure manageable. You'll provide the financial information requested by the platform, and in some circumstances you'll have the option to upload supporting documents. If your circumstances require additional documentation or review, 123 may identify that additional attention is appropriate.

Will my partner see my financial information?

Prenuptial agreements require meaningful financial disclosure between the parties. 123 is designed to organize relevant financial information so that each partner can review the disclosures associated with the prenup process. The platform will explain what information is being shared before you complete the applicable disclosure steps.

Mediation

What is 123 Mediation?

123 Mediation gives you access to a neutral mediator if you and your partner need help resolving disagreements identified during the process. The mediator works with both of you. The mediator does not represent either person and does not take sides.

When would we use mediation?

Usually after completing enough of the 123 process to see where you disagree. You may discover that you agree on almost everything and need help with only one or two issues. That's why we don't require you to purchase mediation upfront. Start for $499. See where you match. Add mediation if you need it.

What can the mediator help us with?

A mediator can help clarify the issues, explain relevant general legal concepts, identify available options, understand what each of you is trying to accomplish and explore possible solutions. When you reach agreement, the resolution can be incorporated back into the 123 process.

Does the mediator represent either of us?

No. A 123 mediator is neutral and does not represent either partner. If you want individualized legal advice based specifically on your own interests, that is the role of your independent attorney.

What happens if mediation doesn't resolve everything?

Neither partner is required to agree to a particular term. If an issue remains unresolved, you can continue discussing it, continue mediation if appropriate, or consult independent counsel. The prenup cannot be completed until the necessary decisions have been made.

Attorneys

Do I need a lawyer to use 123 Prenup?

You do not need to retain a lawyer simply to begin using the platform. Whether independent counsel is appropriate for your situation can depend on your circumstances and applicable law. 123 encourages each partner to consider obtaining independent legal advice before signing a prenuptial agreement.

Can I use my own lawyer?

Absolutely. Your Prenup. Your Lawyer. Your Choice. If you already have an attorney, you can use that lawyer. With your authorization, your attorney can review relevant information and documents from your 123 process.

What if I don't have a lawyer?

You can browse independent attorneys participating in the 123 Participating Attorney Directory. Profiles can provide information about each attorney's experience, services, availability and participating rates. You decide whether to contact or retain an attorney. 123 does not choose an attorney for you.

Does a participating 123 attorney work for 123 Prenup?

No. Participating attorneys are independent lawyers. If you retain one, the attorney represents you — not your partner and not 123 Prenup. Your attorney-client relationship is established separately between you and the attorney.

Can my partner and I use the same lawyer?

An attorney providing independent representation to one partner does not also represent the other partner in the 123 process. If both partners want independent legal representation, each partner should have separate counsel. A neutral mediator is different: the mediator works with both partners but represents neither.

Complexity

What if I own a business or have significant assets?

You can still begin with 123. The platform is designed to identify circumstances that may warrant additional professional attention, including matters involving businesses, trusts, sophisticated compensation, significant assets, unusual ownership arrangements and other complex financial issues. If your answers indicate additional help may be appropriate, 123 can flag that during the process.

Will 123 tell me if my situation is too complicated?

That's part of the design. 123 isn't intended to pretend every prenup is simple. Certain answers or combinations of answers may trigger additional guidance, a complexity notice, or a recommendation that you consider appropriate professional assistance before proceeding.

Completing Your Prenup

Does 123 create a personalized prenup?

Yes. Your prenup is generated based on the decisions and information provided through the 123 process and the applicable agreement-generation rules. It isn't simply the same document with names inserted into blanks.

What happens after our prenup is created?

123 guides you through the remaining review and completion steps. You can review the agreement, obtain independent legal advice if you choose, address any remaining issues and follow the required execution process. The specific requirements can depend on the law applicable to your agreement.

How long does the process take?

That depends largely on the two of you. Couples who already agree on most issues may move through the process relatively quickly. If you have significant financial complexity, unresolved issues, mediation or independent attorneys involved, the process may take longer. 123 is designed to keep the process organized and moving forward without rushing important decisions.

What if our wedding is coming up soon?

Start as early as possible. A prenup is an important legal agreement, and both partners should have adequate time to review the terms, consider independent legal advice and make decisions voluntarily. If your wedding date is approaching quickly, 123 may identify timing as an issue requiring additional attention.

Privacy & Security

Is my information private?

Protecting personal and financial information is an important part of the 123 platform. 123 is designed to use appropriate safeguards for sensitive information and to limit access according to the roles and permissions within the process. Specific information about data handling, retention and security practices will be available in our Privacy Policy and Security information.

Can my partner see all of my answers while I'm completing the questionnaire?

No. Each partner completes individual portions of the process separately. 123 Match is designed to compare the decisions that need to be compared at the appropriate stage rather than simply giving one partner a live view of everything the other person is entering. Financial disclosures and other information that must be shared as part of the prenup process are handled separately.

About 123 Prenup

Is 123 Prenup a law firm?

No. 123 Prenup is a technology platform. 123 does not represent either partner and using the platform does not, by itself, create an attorney-client relationship. If you retain an independent attorney, your attorney-client relationship is established separately with that lawyer.

Who developed 123 Prenup?

123 Prenup was developed with the guidance of a prominent matrimonial lawyer with nearly 30 years of experience handling sophisticated divorce, financial and prenuptial matters. That experience informs the questions, explanations, decision logic and legal architecture behind the platform. Technology makes the process easier. Experience makes the process smarter.

Still Have Questions?

You don't need to understand every part of a prenup before you begin. That's what the process is designed to help you do. Start with the questions. See where you match. Create your prenup.
